1. Scope and purpose of the collection, processing and use of personal data

When you visit the www.richti-park.ch website, our servers temporarily save each access in a log file. The following data is recorded without your intervention and stored by us until automatic deletion after twelve months at the latest:

  • the date and time of access
  • the name and the URL of the retrieved file
  • the website from which the access was made
  • the operating system of your computer and the browser you use
  • the country from which you accessed the site and the language settings of your browser
  • the name of your Internet access provider
  • Number of data transmitted
  • Status message for successful access

This data is collected and processed for the purpose of enabling the use of our website (connection establishment), to permanently guarantee system security and stability and to enable the optimization of our Internet offer, to prevent fraudulent activities or misuse on the website or in connection with the website, to comply with the requirements of the applicable laws, to protect the security of an individual as well as the rights and property of the property owner and to prevent deception or security or technical problems, as well as for internal statistical purposes. This is our legitimate interest in data processing within the meaning of Art. 6 para. 1 lit. f GDPR. In particular, the IP address is used to record the country of residence of the website visitor and to set a corresponding default language for the website. Furthermore, the IP address is evaluated for statistical purposes in the event of attacks on the network infrastructure of www.richti-park.ch.

In addition, we use so-called pixels and cookies to use web analysis services when visiting our website. You will find more details on this in Sections 5 and 6 of this data protection declaration.

Our legitimate interest in the processing of your enquiry lies in the processing of your enquiry in accordance with Art. 6 Para. 1 lit. f GDPR. Contact by electronic mail (e-mail):

Information that you send to us unencrypted by electronic mail (e-mail) may be read by third parties during transmission. In general, we cannot verify your identity and do not know who is behind an e-mail address. A legally secure communication by simple e-mail is therefore not guaranteed. We use - like many e-mail providers - filters against unwanted advertising ("SPAM filters"), which in rare cases also automatically classify normal e-mails as unwanted advertising and delete them. E-mails which contain damaging programs ("viruses") are automatically deleted by us in any case. If you want to send us messages that require protection, we recommend that you send them to us by conventional mail.

Please also inform us whether and how we can send you encrypted e-mails to reply to your letter and, if this is not possible, whether you agree to an unencrypted reply to your letter by e-mail. If you do not have the possibility to receive encrypted e-mails, we would ask you to give us your postal address in order to reply to your messages that are worthy of protection.

Contents of the website can also be shared via e-mail (so-called MailShare). If an e-mail is sent via this function, the data protection conditions of the respective mail provider apply (i.e. those of Gmail, GMX, Hotmail etc. or those of your employer, depending on the case). E-mail data entered by the user for the MailShare function is not stored by the property owner or marketer.

2. Transmission of the data to third parties

We only forward your personal data if you have expressly consented, if there is a legal obligation to do so or if this is necessary to enforce our rights, in particular to enforce claims arising from the relationship between you and the property owner and the marketer.

In addition, we pass on your data to third parties, as far as this is necessary within the scope of the use of the website for the provision of the services requested by you and for the analysis of your user behavior. Insofar as this is necessary for the purposes mentioned in sentence 1, the transfer can also take place abroad. 3. Transmission of personal data abroad

The property owner is also entitled to transfer your personal data to third companies (commissioned service providers) abroad, insofar as this is necessary for the data processing described in this data protection declaration. These companies are obliged to the same extent as we are ourselves to protect data. As a matter of principle, the property owner does not transfer personal data to non-EEA countries. The servers used are located exclusively in Switzerland.

We also take the company's internal data protection very seriously. Our employees and the service companies we commission have been obligated by us to maintain confidentiality and to comply with data protection regulations.

5. Cookies

Cookies help in many ways to make your visit to our website easier, more pleasant and more relevant. 6. Google Analytics

On our website we use the web analysis service Google Analytics from Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"). This means that information about the surfing behaviour of website visitors is collected for marketing purposes in a purely anonymous form and cookies are set for this purpose. No personal data is collected or stored in this process.

In the evaluation of the use of the website, the compilation of the website activity and other services in connection with the use of the website and the internet, we have a justified interest in data processing. The information generated by Google Analytics with the help of cookies about the use of the website - including the anonymous IP address - is transmitted to a server of Google Inc. in the USA. The anonymization is achieved by removing the last eight bits of the IP address, which makes it impossible to clearly assign the data collected to a specific IP address. This information is transmitted to authorities or third parties if Google is legally obliged to do so or if third parties are acting as service providers on behalf of Google.

7. External Services

This website uses Google Maps API, a map service of Google Inc. ("Google"), to display an interactive map and to create directions to the site. Google Maps is operated by Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

By using Google Maps, information about your use of this website (including your IP address) can be transmitted to a Google server in the USA and stored there. Google may transfer the information obtained through Maps to third parties if this is required by law or if third parties process this data on behalf of Google.

Google will not associate your IP address with any other data held by Google. Nevertheless, it would be technically possible for Google to identify at least individual users on the basis of the data received. It would be possible that personal data and personality profiles of users of the website could be processed by Google for other purposes over which we have and can have no influence. You have the option of deactivating the Google Maps service and thus preventing data transfer to Google by disabling JavaScript in your browser. However, we would like to point out that in this case you will not be able to use the map display on our site.

8. Note on Data Transmissions to the USA

For the purpose of comprehensiveness, we would like to point out to users who are resident or domiciled in Switzerland that surveillance measures are in place in the USA by US authorities, which generally allow the storage of all personal data of all persons whose data has been transferred from Switzerland to the USA. This is done without any differentiation, restriction or exception based on the objective pursued and without any objective criterion that would make it possible to limit access to the data by the US authorities and its subsequent use to very specific, strictly limited purposes that could justify the interference associated with both access to and use of the data. Furthermore, we would like to point out that there are no legal remedies available in the United States for data subjects from Switzerland that would allow them to gain access to the data concerning them and to obtain its correction or deletion, or that there is no effective judicial protection against general access rights of US authorities. We explicitly draw the data subject's attention to this legal and factual situation in order to make an appropriately informed decision to consent to the use of his or her data.

Users residing in a member state of the EU are advised that the USA does not provide an adequate level of data protection from the perspective of the European Union - among other things due to the issues mentioned in this section. Insofar as we have explained in this privacy policy that recipients of data (such as Google, Facebook and Twitter) are based in the USA, we will ensure that your data is protected at an adequate level with our partners, either through contractual arrangements with these companies or by ensuring that these companies are certified under the EU-US Privacy Shield.

9. Right of access, rectification, erasure and limitation of processing; right of data transfer

You have the right to request information free of charge about the personal data that we store about you. In addition, you have the right to have incorrect data corrected and the right to have your personal data deleted ("right to be forgotten"), unless this is prevented by a legal obligation to retain data or by a permit that allows us to process the data. You also have the right to demand that the data you have provided us with be returned to you (right to data portability). Upon request, we will also pass on the data to a third party of your choice. You have the right to receive the data in a standard file format.

You can also inform us what is to be done with your data in the event of your death by giving us instructions.

10. Retention of data

We store personal data only as long as it is necessary

  • to use the above-mentioned tracking, advertising and analysis services within the scope of our legitimate interest;
  • to carry out services to the above-mentioned extent that you have requested or for which you have given your consent (e.g. for job placement in accordance with item 1);
  • to comply with our legal obligations.

Contract data will be kept by us for a longer period of time, as this is required by legal retention obligations. Retention obligations which oblige us to retain data result from accounting regulations and tax law provisions. If we no longer need this data to perform services for you, the data will be blocked. This means that the data may then only be used for accounting and tax purposes.

11. Right to complain to a data protection supervisory authority

12. Modification of privacy policy
